Creative Commons: Solution or Just More Problems?

Between illegal music, film and television downloads, software downloads and burning DVDs and CDs, piracy is bigger than ever. So, in the age of the internet, how do you get your stuff out there to the masses, without it being stolen or subjected to unauthorized change? And, most importantly, how can you copyright your work without being setback thousands of dollars in legal fees? Some governments believe they have found the solution in Creative Commons licensing. The purpose of this paper is to discuss the pros and cons of Creative Commons, and to discover if it is a success, or failure, in dealing with authorship and copyright on the internet.

What is Creative Commons?






Creative Commons is a license program that provides “free licenses that let creators give permission in advance for certain use of their material.” [1] Which means, under one of these licenses, all work that is produced under it is automatically protected by copyright. It also means that (depending on which particular type of license chosen) creators can not only share their work, but allow for it to be copied, modified or remixed. They were created by a non-profit organization, and promote sharing creative works across cultural, geographical and generation borders. There are four different elements to the licenses. Attribution (BY) means you must credit the creator, title and license. Noncommercial (NC) means any use of the work must be for noncommercial purposes only, while No Derivative Works (ND) means only verbatim copies of the works can be used. Lastly, Share Alike (SA) means any new work using the material must be made available under the same terms. These four elements mixed together to make six licenses available:

i. Attribution (BY) Commercial and Noncommercial: Can copy, adapt or modify, distribute, license to others
ii. Attribution-Noncommercial (BY-NC) Noncommercial only: Can copy, adapt or modify, distribute and license
iii. Attribution-Share Alike (BY-SA) Commercial and Noncommercial: Can copy, adapt or modify, distribute and license on the same term as the original
iv. Attribution-No Derivative Works (BY-ND) Commercial and Noncommercial: Can copy, distribute verbatim copies only and license
v. Attribution-Noncommercial-Share Alike (BY-NC-SA) Noncommercial only: Can copy, adapt or modify, distribute and license on the same terms as the original
vi. Attribution-Noncommercial-Non Derivative Works (BY-NC-ND) Noncommercial only: Can copy, distribute verbatim copies only and license to others

What are the Benefits of Creative Commons?

Creative Commons licenses are global designed and recognized; they are enforced with the same tactics and effects in any place at any time around the world. This is a major benefit with using the internet to share creative works, and allows legal sharing all across the world wide web. Every license of Creative Commons enforces authorship; users must credit the original author of the work. They are also fairly easy to understand, and there are sites for every country using the Creative Commons initiative that explains them in detail, leaving less room for accidental copyright infringement. Most importantly, Creative Commons licenses are free, and if breached, standard copyright laws apply. The popularity and need for Creative Commons is becoming apparent, with mainstream search engines like Yahoo and Google allowing image searches specifically for content protected by a Creative Commons license. Popular photo sharing site Flickr also has a Creative Commons license generator. This proves the need for free copyright licensing on the internet is becoming greatly needed, and more wide spread. The most important benefit of this licensing however, is that it is a free and completely legal way to share creative works, still under the protection of copyright.

What are some problems with Creative Commons licensing?
Even though Creative Commons provides a solution the the issue of copyright on the internet, it is also a failure. There are still many issues with the licenses, which are constantly being looked over and discussed by creators and critics of Creative Commons. A large issue for many people is that the licenses are irrevocable; once work is under a Creative Commons license, it can not be changed or revoked. This issue paves way for many another problems with the licenses. For example, even if the works peak the interests of professionals (such as publishers or record companies), it is unlikely a company would invest in the works as they are already available for free. This means the creator of the works waive all ability to collect royalties, and given that the Creative Commons licenses are irrevocable, can never make money from them. This means for many people that the Creative Commons licenses are financially impractical, and are only suited to creators who can afford to share their works for free, or people who are not planning to receive any income from their creative works. There are also other problems with the program, like the authentication of applying for a Creative Commons license, lack of support for rights enforcement, moral rights protection for performers within the works and the issue of co-creators. As yet in the Australian Creative Commons format, their is no moral liability for performers of or in the creative works protected by the licenses, and can not receive profits nor recognition for their part.




In conclusion, Creative Commons licensing is a step forward in dealing with copyright and authorship on the internet; though there are still many glitches that need to be addressed within the configuration. It is successful in the promotion of sharing knowledge over a wide axis, including cultures, age, and location. Even though no profits are received from the works, it allows creators to get across to audiences what can be done with their work, and in turn receive recognition they deserve. In the age of piracy, any attempt in legal and accurate internet copyright is significant. Creativity is the lifeblood of many cultures, and the internet is one of the easiest and broadest audiences to share it with. While there is much room for improvement, Creative Commons still helps do this legally, safely and efficiently.

So hot. It is absolutely convergent technology, has email, internet, adobe, office, mp3, massive amounts of memory and a whole heap of other crap that I will probably never use.

OH in further news, totally got a ticket to the Big Day Out next year. Highlights will be (granted the timetable is kind to me) Muse, Kasabian, Lily, Calvin, Dizzie, Bluejuice, Mars Volta, Temper Trap, Kisschasy, The Horrors. Don't think I'm gonna get away with everyone, but I'll give it a right go.

My friend brought back from overseas a box set type thing with the booklet from the show, the vinyl soundtrack (with amazing pictures) and this beautiful original picture (which I had framed for obvious reasons...it's awesome). The pic is off my phone so sorry for the lack of size.




News Schmoos

Still trying the political stuff... Responding to a news blogger is not my forte. This leads me to think I am not smart. But some people really take this stuff seriously, and if you make a comment they don't like, you become some kind of matyr figure, virtually stoned to death with vicious comments. So while I have looked at many news blogs, cnn, that guy that writes the channel ten blog ( I forget his name, it's late), and some other news folk blogs that have opinions on stories that make them seem nothing less than stuck up, know-it-all pretentious a-holes. Looking around at these, and the comments of peoples responses, I feel inadequete in any response that I think of.
Like I said, politics and news aren't my forte.

Politics

I had a whole lot of trouble trying to use the hansard online; it's probably my laptop being a pain but I'm not sure. I looked up Ros Bates' website instead, and discovered she will be speaking in parliment today on the cognate Education Bills. She also has a heap of petitions and action posts on her site like a good MP. There is also a bit of the site that has all of her speeches. I am yet to find a way to respond to this however. I guess I'll just send an email. She is also on all of the social networking sites so I guess I can respond that way also. Politics is not my forte, nor is it any interest to me. Just putting that out there.

Knee Fail

So back on monday, Day 2 of National Uni Games, game 2, I managed to damage my meniscus (cartilage that supports the joints in your knee) in my left knee. I am now on crutches for an unknown amount of time, with a fat, bruised, and sore knee. I have spent the last 2 days and 1 night at home (after paying $250 for a motel in surfers paradise), feeling terribly sick from the codiene and anti inflammatorys the hospital gave me, a sore throat from one of the girls I have been sharing a room with and sore arm pits from my ever frustrating crutches. But other than that, I have been having a splendid uni break.

Oh, at the opening ceremony at Sea World on sunday night, I saw, among other things, a guy dressed up like the Hitcher from boosh. Awesome. (Yes, I got a photo. Not quite Noel Fielding, but still. Awesome. Oh, Jay and the Doctor from Frenzal Rhomb were there too. Didn't get a pic though. Bummer.)

To Clean Feed, Or Not To Clean Feed

I have been reading up on this 'Clean Feed' business, and found that so far, I am torn about the whole idea. It is a very good thing that the Australian Government are trying to implement ways to protect children from some of the horrors floating around on the internet. This just seems like a very extreme way to do it. And it seems suspiciously on the down low. I can't seem to find any information on things like who will decide which sites are blacklisted. I mean, obviously illegal things will be, but there is the freedom of speech concern. And I'm sure I'm not the only one to come across a funny named site, that doesn't actually have anything to do with it's content. How many of these will be blacklisted accidentally? What about blogs? And is that someones job? To find illegal and inappropriate sites to filter? Like terrorists sites and child pornography? Would that not make someone want to kill themselves? And if this really is a technique to protect kids from laying innocent eyes on something they shouldn't, why is the filter being placed in homes without children? It all seems a little dodge. Plus, I get frustrated with slow internet as is. Apparently, this filter will only make it slower. I see a rise of computer abuse in my future. Not to mention, how much is this going to cost? Surely there is an easy way to do this, without spending millions of tax payers money when it should be spent on better things like the health care system? Those road works in surfers have been going for months now, surely another million dollars would move that along quite nicely. So in conclusion, still torn. It will be interesting to see what happens when it goes ahead though. Another Vegemite 'iSnack 2.0' scenario perhaps?

Gosh it's taking a lot of frustration and effort to get this post up... is it really necessary, I have to ask? Anyway, sorry it's taken so long to get these films up, but I think you'll agree it was worth the wait... not sure if its worth the anger and content though.

"Solve for X" is a 35mm black & white action short that follows the story of a few days in the life of a hitman. This 11 minute film contains adult language, themes and violence (ie, no littlens.) Scott Spears, Emmy award winner, is the director of photography. The piece was written & directed by John Whitney and stars Rafael Rosado, a professional animator, director of several animated shows like Men In Black: The Series & Ghostbusters



"Third Wheel" is an award winning short film that tells the story of Charlie Watts. He is cheating on his supportive wife of seven years. The subject of his affair is the beautiful Lindsey Cavanaugh. He plans to get rid of his wife, but Lindsey has other plans. And so begins an adventuresome round of plot twists that build to a suprise-filled climax.



Little less serious one, an authorized (parody) documentary into the life of criminal minds star Matthew Gray Gubler



These days even some music film clips are considered short films, and are huge online. Examples:

Comedy clips from The Lonely Island (you know, the Jizz In My Pants and I'm On A Boat guys) are huge online, and a tv show that they made just for online fans called "The Bu" (Young, sexy people that live in Malibu call it 'The Bu', because when you say the entire word, it takes time, and then you wouldn't be young anymore.)

Speaking comedy, lets not forget those guys at Funny or Die (Will Ferrell being one of them), the same people that bought us The Landlord.




I chose these films because... I like miniture earth because I like the thought that the internet and films can both have an important message (very rare combination as far as I can tell)
I like action films.
I love all of Matthew Gray Gublers stuff, because (in his words) there is no reason not to make movies. I love that just about anyone can make films these days, and it really opens the doors for independent shorts like his. And he is hilarious.
I also love bands that put effort into their film clips. You make them to sell the music, and these songs all prove that.

I think this website is rad. A little frightning, but rad. There is more to do on this than facebook. Not like thats a major feat or anthing. There is an earthquake happening in Peru, and one in Alaska, right now. Amazing. Though it would scare the shit out of me to see something near here, I'm not sure I'd want to know. Kinda like those sites where you can find all the sexual offenders that live in your postcode area. Seems like a fun thing to do until you do it. Until you realise you live in rapeville. But I do like this site, and when you click a specific one, it pops up with all the info on it, like a disaster baseball card. Fantastic.

PortableApps

So... like I said before I have already used portableapps.com, I downloaded openoffice for my laptop and it's pretty awesome... except spell check TOTALLY doesn't work. But I deal. I also have VLC which is the best thing ever. That program will play literally anything. There is nothing it can't do. I would like to download gimp at some stage but my parents computer already has photoshop so... maybe later. But I totally love VLC. It plays all my absolutely legally downloaded videos (supernatural aired in the US last night yahooooooo!), other region dvds (isn't it the most irritating thing when you get this amazing box set of one of your favourite shows from ebay and its only when you try and play it in your 5 year old dvd player that its a different region, one that your dvd player from medieval times can't play?), converted youtube videos and the like. It's the best thing I have ever downloaded for free.

So this week autobot followers, I was quite an unwell robot and couldn't make it to the tutorial. But LUCKILY (or unluckily some might say... if that is even a word. I don't think it is) the tasks were up on the class blogs. So, as I lie here on my death bed, I will lay the tasks out for you.

Basically it says we are required to go on an internet scavenger hunt of sorts - no google. LAME. So I mainly used Yahoo, wikipedia and even Internet Movie Database ( one of my personal favourites).

1. So I couldn't find the current World's Biggest Pumpkin (though I think it should be front page news) but the winner for 2008 was Steve Connolly, who's pumpkin weighed in at 1568 pounds. Nice. (www.bigpumpkins.com. Yes, the site is real. I know.)

2. Given Lily Allen is a myspace queen, you think it would be easy finding a way to contact her. WRONG. I'm thinking upper management, like her record label, but she seems to use Twitter a lot so, give that a try. Why you would want to contact her though is beyond me.3. Thanks to wikipedia, I now know that a giraffe tongue is around 18 inches. With that knowledge, how could I ever fail in life.

4. Glycomics is basically the study of sugar, in all its forms, and the relationship to different organisms. An ECU is an extreme close up which has a focus on an certain aspect of a person, either the mouth of eyes. This allows the responder to get an view of the character.

A WS is a wide shot which gives the audience a wide view of a an scene. This is normally used to show a particular area or landscape.


A MS or Medium shot is used to show either posture or physical movement.God Spiderman 3 was terrible. Ruined the whole story. Stick to the comics and cartoons people, Tobey Maguire was a bad choice. Don't get me wrong he is a great actor (best cameo award for Tropic Thunder) but not a good choice for Peter Parker.

Toyota Partner Robots
The Toyota Partner Robots are a series of robots developed by Toyota to enrich and assist the lives of Japans aging population. They debuted playing music on drums and trumpets at the 2005 World EXPO in Aichi, Japan. There are 5 robots in all, most of which, have different movement system. The 5 robots are: Version 1 (bipedal robot), Version 2 (segway-like wheels), Version 3 (segway-like wheels), Version 4 (unique wire system) and the Mountable Type (2 legs)

Convergence

Convergence is two or more technologies that have been created joining (or 'converging', even) together to create one piece of technology that can utilize both original uses. For example, I have a phone (not that I need it, being a robot) that can use the internet, as well as do all the things a mobile phone could originally do. This is helpful as for some reason, some people leave me facebook posts instead of picking up a phone or texting me. Like a check my facebook page ever two seconds. Except now I do because of these people. Damn!

New Com Tech

Being Optimus Prime, one would assume that I am good with computers. But seriously, who invented Macs. This is one of the reasons I am doing this new communications technology course. In this first class I have set up my very own blog. So instead of using all my energy transmitting messages into the vastness of space, I will use this site instead. I have even managed to put up a picture of myself on the profile and a picture in an old post. Aren't I a clever robot. Until next week my friends, Prime out.
